Le «spiegazioni» della Carta dei diritti fondamentali dell’Unione europea

II-112 of the European Constitution. The essay presents an analysis of the origins of the «explanations» at the time of the “first” Convention: on the one side, they are considered in relation with the initial British proposal of a Charter constituted by two different parts; on the other, the “non-democratic” nature of the approval of the «explanations» is highlighted. The content of the «explanations» is then thoroughly examined, together with the main related issues. In particular, due attention is paid to: a) relations between the Charter and the 1950 ECHR, and between the European Court of Human Rights and the European Court of Justice: these relations are analysed taking into consideration art. 52, par. 3 of the Charter and its «explanation» in its subsequent forms; b) the issue of limitations to the Charter rights: in this respect, the essay puts forward an innovative reconstruction, respecting the norms of the Charter, based upon a number of objective elements; c) the role to be acknowledged generally to the «explanations» and specifically to the sources they relate to: objective and technical elements are brought about instead of subjective and political ones; d) specific cases where the «explanations» tend to enhance the provisions of the Charter and not, as usually maintained, to limit its effects: a variety of examples is thus presented.
