This essay concerns the status of the author’s moral right, especially considering supranational law, in particular European Union Law. Many authors believe that supranational legislation does not protect the author’s moral right, as it appears more interested in pecuniary aspects. However, already in light of Article 27.2 of the Universal Declaration of Human Rights, which states that “Everyone has the right to the protection of the moral and material interests resulting from any scientific, literary or artistic production of which he is the author”, it is possible to reach a different conclusion. This work, through a detailed analysis of the provisions of the Berne Convention, explores critically the author’s right to be identified as such on each copy of the work or in any act of its use.
