In my first article (GRUR Int. 2017, 301 and Journal of Intellectual Property Law & Practice (2017) 12 (6): 516-525) I reached the conclusion that, after and because of the withdrawal of the UK from the European Union, the entire Patent Package, including the UPCA (the agreement on the UPC), will become inapplicable to the UK. In this new paper I propose a possible way to have the Patent Package entering into force, notwithstanding the withdrawal of the UK, but without the participation of this country.
