Following the adoption of Council Regulation (EU) No. 1259/2010, implementing enhanced cooperation in the area of the law applicable to divorce and legal separation, a new approach has been implemented for participating Member States inasmuch the possibility for the spouses to choose applicable law has been introduced albeit within a limited number of options. This paper provides an overview of the key features of the current EU legal framework devoting special attention to its concrete application in the light of the case-law developed by Italian courts.
