This paper questions hte relationship between two distinct disciplines: the antitrust law, on one side; and the (special) alw of collective management on hte other. The study starts from examining a recent decision of the administrative court of Lazio with which certain conduct held yb SIAE has been qualified as illegal conduct for abuse of dominant position according to art. 102 TFEU, both ni the so-called market upstream, both ni the so-caled market downstream of the collective management of copyright, excluding the exemption's operation under art. 106 TFEU.
